Private Disability Lien 4 Years, 3 Months ago  
I am now receiving disability through my employer's insurance carrier. They tell me that after I win Social Security benefits that I will have to pay them back some of the money they paid me. Why do I have to pay them back anything? How does this work?

Most, if not all private disability policies, pay the following:

1. The amount covered by their own policy of insurance;

2. An estimated amount of money equal to what they believe you should be receiving from Social Security disability (while you are waiting for Social Security to determine your claim).

The private disability carriers pay the extra estimated amount to people like you with the hope that you can survive financially until your Social Security disability claim has been awarded.

Once your Social Security claim is awarded, some or all of the money that the private disability carrier paid to you will need to be reimbursed to them with the back benefit amount that you receive from Social Security. The private disability carrier will then decrease the amount of the monthly payment that they pay to you once you begin receiving Social Security disability payments.

So it is extremely important for you to obtain a complete copy of the policy of insurance that was in affect at the time that you first applied to the private disability carrier for benefits. The policy language will dictate how much money will need to be reimbursed to them once you have won your Social Security disability claim.
