Yes, Social Security is allowed to recover back any SSI benefits that they paid out to you while you were awaiting the result of your disability claim. But it is important for you to review your records and make sure that the amount that they are claiming that you received in SSI benefits is correct. If you dispute that amount for any reason, you must file an appeal of the overpayment request.

Additionally, if it is a hardship for you to pay back the $4322 to Social Security you can request a reasonable monthly payment plan for you to pay it back, or, you can file what is called a waiver of overpayment requesting that Social Security not require you to pay these funds back to them.

Examples of hardship are as follows:

you could lose your home
you have a huge medical bill that you must pay back
you have a very sick child at home with you

If you can prove hardship, Social Security may decide not to seek reimbursement of the $4322 from you.
