The answer is yes. A claimant can ask the judge to hold up on making a determination until after the claimant has had an opportunity to retain a representative and present all pertinent evidence in support of the claim. But keep in mind that depending upon a claimant's claim history, a judge may not allow the claimant to retain a representative post-hearing. If the judge then denies the claim, the claimant has the right to take the claim before an appeals council for further review.
