Can I file another claim? 4 Years, 1 Month ago  
About a year ago, I filed a claim for disability but it was denied. My medical problems are much worse now. Can I file another disability claim?

You may file a new claim, however, it is best to reopen the old claim which will render you a much longer period of time for retroactive benefits. (Retroactive benefits begin from the date that you stopped working because of your physical impairments, less the five month waiting period).

The old claim may be re-opened if new and material evidence needs to be presented, if a clerical mistake was made or an error of evidence may have been made on the initial claim.

For SSDI claimants, you may reopen the claim if it is done within 12 months of the initial denial. For SSI claims, you must reopen the claim within two years. However, there is no limitation on when a claimant may reopen an SSDI or SSI claim if the person lacked the mental capacity to comprehend the procedures required to file the appeal.
