I have a pending disability claim. If I get benefits, can my children also get benefits?

Once an individual has been awarded disability benefits, certain family members are also eligible to receive benefits. Family benefits are paid _base_d upon the amount of earnings of the insured family member. The following individuals may qualify for family benefits:

a spouse or divorced spouse;

a dependent and unmarried child;

a parent of an insured child which child may have died and who was insured prior to his or her death and whose parent is 62 years old;

a parent who is divorced, widowed or unmarried and did not remarry after the insured child's death,

the parent was receiving at least one-half of the child's support prior to the child's death and the parent can show proof that the child's benefits were used to support him or herself.

Specifically in answer to your question, a child of an individual awarded disability benefits may receive family benefits if the child is under age 18; if the child is age 18 or 19 and a full time student or the child is an adult and has been disabled prior to reaching the age of 22.

If a child didn't know about getting there fathers ssi is there something u can do to get it. or can you receive the retirement check.

I do not believe that the children would have a right to the father's retirement benefits, however, I would suggest you contact the Social Security Administration at 1-800-772-1213 to find out if the children may have a right to collect retroactive SSI benefits against the father's claim.
