alj denial 2 Years, 9 Months ago

I just received the decision from the alj from my hearing (unfavorable). I have representation and am wainting to hear from them. I am hoping they will appeal, but not sure. Can I change representation at this point if they decide not to go further and not appeal?

If your current representative does not wish to appeal the matter to the Appeals Council, after your claim was lost at the hearing level, you most certainly may opt to appoint a new representative to handle the appeal from this point forward.

is it usual for a social security lawyer to decide not to file for the appeals council review? I have a legal aid service in my area that appeals to people who have been denied assistance by two lawyers, they work only for those who have been told that they will not be able to be worked for by two different attorneys

It is up to the individual attorney/representative to make an educated decision about their chances for success on an appeal of a claim.
An attorney/representative may decide to end their representation of a claimant at almost any point during a claim, except if a judge instructs them to continue with the representation.

Yes, they did decide to drop me. I made three attempts to contact them that first week with no results. They sent me a letter in the mail 2 weeks later. Since then I have been attempting to find representation with no success. I've already appealed to the council, so I'm on my own as of right now.
